First of all, if it's press, then most of the time we do not take any action as far as photo rights. We do for specialized magazines and text books. The first thing I do is have whoever send a brief, formal proposal stating exactly what they want the image for and why. After I receive the proposal, I fax it to the appropriate party for their permission (the artists gallery, ARS, the artist themselves, etc.) If the artist says 'yes' I send the person the slide or slides, an invoice for one time use of the slide ($50.00 for a magazine, $35.00 for a text book) our standard Photo Release Form which states that they must credit the image appropriately, no cropping allowed, and that they only have permission to use the image one time. And then it is done. The other kind of request I receive are from people who would like to take pictures themselves in which case we have a Photo Release Form for that particularly. And then we have several requests from teachers. When it is for educational purposes, we do not ask for permission from the artists, and we do not have a fee, however we do have a specialized Photo Release Form we have them sign stating that they will only use the image for educational purposes.
