Case #2: Resale Price Maintenance

A case has come before you in which an oil company signed an agreement with the gas stations it distributes to which set the maximum amount any station may set charge for the gas they sell. A certain gas station refused to abide by this agreement, and the oil company filed suit.

The owners of the gas station are asking that the court defend their right to charge anything they want for their product and allow the market forces of supply and demand decide the price. They back up the request with a precedent, a 1968 case which prohibited a newspaper publisher from setting a maximum retail price for their paper. Their plea lies in your hands.
