I agree, a bright sky makes your subject backlit. Another way to present this photo would be to crop the scan more tightly -- the JPEG compression causes bad edges on the bird. A smaller area would require less compression to produce a reasonable size file and the edges would be cleaner, but then the Halls wouldn't have their wallpaper :-).
