According to Rohn Engh in "Sell & Re-Sell Your Phots" (1981) "Generally speaking, news pictures that report current happenings or illustrate other items of public interest need not have the model's permission to be used." "Under the First Amendment of the U.S. Constitution, photographs may be used without releases if they are related to the subject they illustrate [in a magazine, book or newspaper] ... and they are of public interest." "Pictures that might shock what's defined as the normal sensibilities of ordinary people may be categorized as outside the 'inform or educate' interpretations [and require a release]. Some sensitive areas include mental illness, crime, medicine, religion and sex education." "... model releases are usually required in service photography [e.g., put to commercial use to sell a product]."
