Sculptural and Photographic Resources:

Important Legal Note: Due to difficulties in directly communicating with the publishers and photographers whose works provided the source for non-graphical images, usage of their work stringently abided by the Fair Use Law. Under this law, there exist 4 points or "factors" that aid in the legimization of the using of copyrighted or otherwise  protected materials.  The four factors respresent the attempt to quantify, categorize, and classify an important law (originating with the founding of the United States) that is highly subjective and extraordinarily complex.  The first point is to determine the "character of use."  All the images used in compliance with the guidelines of the Copyright Law which are herein reviewed are photographs of sculptural works that were originally produced by ancient Greek sculptors nearly 2500 years ago.  The "character of use" for these photos is educational for the general public, as the entire page functions, with its various parts (including these copyrighted photographs), as an educational web site dedicated to informing those who want to learn about Classical Greek Sculpture.  By this same logic, the makers of this web site hope that the additional effect of this page will be to stimulate public interest in the subject of  Classical Greek Sculpture, and as this page offers, at most, a thorough "survey" of  said subject - whereas much of the resources used to create this "survey" (including these copyrighted photographs) can provide one with a more in-depth and thorough analysis of the entire subject of Classical Greek Sculpture.   For  this reason, a suggested reading list has been created that lists these more complete  works  which contain the copyrighted images such that the "character  of use" of this web site  does not overlap completly with the "character of use" of the resources containing the copyrighted photographs which are intended for a higher-level college student of art history.  According to factor One an educational "character of use" helps add to legitimate use.  Factor two is the "nature of the work," which in this case can be seen as either the art of the sculpture itself, or the representation of it by photographic means.  For the purposes of this law, the "nature of the work" used is published factual representation of the sculpture by photographic means.  And according to factor two any material used that equates a published fact further adds legimization  points (in other words: the more points the more legal).  The third factor was carefully taken into consideration with the design of this web site as it involves determining "how much" material (in case the photographs) is to be used.  Adhereing to this point,  no more  than 2 or 3 (in one case though, four images were used)  photographs were used that were taken from any single resource (i.e. one book).  The final factor is the "market effect" of the usage of the copyrighted material.  According to the makers' of this page best judgements the only possible "market effect" (one that has already been touched on here in this legal note of justification) is a stimulated interest in higher-level Classical Greek  Sculptural publication market.  The educational "character" of this web site should not effect (as it is non-commercial) the Classical Greek Sculptural publication market, for these copyrighted photographs in any other than a beneficial way.  The result of these four factors is understood by the makers of this web site to justify legitimized use of the below listed "photographic resources." Data for this fair use test and legal  understanding was obtained from the University of Texas System: Office of General Counsel at:  <http://www.utsystem.edu/OGC/IntellectualProperty/copypol2.htm>.
