Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

This amendment protects the accused from any unwarranted bail, fine, or punishment. This is the major source of opposition to the death penalty as many claim it is a "cruel and unusual punishment." (Ratified December 1791.)
